People laugh when I ask if they would use their spouse's attorney if filing for a divorce, but they readily use a traditional agent when looking for a house.  A real estate agent, like an attorney, has a legal duty to help their client attain their goals.  In New York, a real estate agent always works for the seller UNLESS you have an agreement (usually in writing) which states that the agent works for you.
